Consortia registration terms and conditions
Where you consider that any information provided by you to Scottish and Southern Electricity Networks should be treated as confidential, that fact must be confirmed by you to Scottish and Southern Electricity Networks in writing.
To ensure the accuracy of the information contained in the register, after 12 months (or such other period as we consider appropriate), we may elect to discard and/or not disclose the information supplied by you through this webpage to other subscribed third parties, but we shall (at our sole option) be entitled to retain the information for such period as we consider necessary or appropriate. We may take reasonable steps to verify the information supplied from developers to Scottish and Southern Electricity Networks, but in order to ensure the efficacy of the system, it is important that the information submitted by developers is as accurate as possible. Therefore, there will be an onus on developers to ensure the accuracy and completeness of the information which they upload. Scottish and Southern Electricity Networks does not accept any liability for inaccurate, incomplete or misinterpreted data.
By providing information to Scottish and Southern Electricity Networks, you also consent to Scottish and Southern Electricity Networks sharing that data with third parties where required under any statutory, regulatory or licence requirement placed on Scottish and Southern Electricity Networks. We may use the data in an anonymised form where necessary. For example, to provide information to the industry regulator (Ofgem) of the number of projects or explain how the system works, we might state “We have x number of successful connection consortia arising from our system”.
Severance
If any of these provisions should be determined unlawful, invalid or otherwise unenforceable by reason of law then, to the extent and within the jurisdiction which that provision is found to be unlawful, invalid or unenforceable, then that provision shall be deleted and shall not affect the validity and enforceability of the remaining provisions which shall continue to be binding and in force.
Governing Law and Jurisdiction
These terms and conditions and any dispute arising herein shall be governed by and construed in accordance with the laws of either England or Wales or Scotland depending on the country from which access is made, and subject to the exclusive jurisdiction of the English or Scottish Courts, whichever is applicable.
